At Seeker, we provide terms of service to govern the use of our website and services. These terms outline the rules and regulations for using Seeker's website and search portal. These Terms and Conditions (“Terms”)govern your use of the Seeker service provided by Seeker Technologies Limited (“we,” “us,” “our”). Seeker Technologies Limited is registered in England and Wales under company number 17250203, with its registered office at 55 Rectory Grove, Leigh-on-Sea, Essex, SS9 2HA. By using our service, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, you must not use our service.

1. Service Description

Seeker will search for stolen items on the following websites selling second-hand goods: eBay UK, Gumtree UK and Facebook Marketplace UK. Preloved UK, Vinted UK and Shpock UK will be added soon.

On the Advanced Patrol and Ultimate Search packages, Seeker will send a stolen-item alert about your item to its partner second-hand retail stores. Basic Search does not include store alerts. Store alerts contain item details, photos chosen by our staff, the date of the theft, the first part of the postcode and your case reference. They never contain your name or contact details. We tell you how many stores in which general area were alerted, but not which stores. See our Privacy Policy for details.

Users' input details of their stolen item will be used as the search categories and our technology will use these details to search for matches.

Seeker will run daily automated searches for the exact period as stated in the details of each of our packages.

2. No Guarantees and Refund Policy

2.1 No Guarantees: while we strive to find matches for your stolen items, we cannot guarantee that your item will be found. The search results depend on the information provided by you and the accuracy of the listings on the websites we search.

2.2 No Refunds: we do not offer refunds once you have paid for a search. Once payment is made, our technology is automatically set into action, and the service is considered delivered.

3. Limitations of Liability

3.1 Service Limitations: we do not accept responsibility for reclaiming items. Our role is limited to providing information about potential matches and, on eligible packages, alerting partner stores. Partner stores are independent businesses. We cannot guarantee that a store will see an alert or recognise your item.

3.2 Indirect Damages: we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from your use of the service.

4. Data Privacy and Security

4.1 Personal Information: we take privacy and security seriously. We never share your name, email address, phone number, address, full postcode or proof-of-ownership documents with partner stores. We use service providers (such as Stripe for payments) to run the service. How we use, share and keep your information is set out in our Privacy Policy, which forms part of these Terms.

4.2 Store alerts: on packages that include partner store alerts, you agree that we may share your item details and the item photos chosen by our staff with partner stores, as described in section 1 and in our Privacy Policy. Partner stores are bound by confidentiality terms. You can ask us to withdraw an alert at any time by emailing support@searchbyseeker.com.

4.3 Retention:your account and reports stay available until you delete your account. After you delete it, you have 30 days to restore it, and then we erase it, except for records we must keep by law. When a store alert ends, we redact the stores' copy.

5. User Responsibilities

5.1 Accurate Information: you are responsible for providing accurate and complete information about your stolen item. The accuracy of our search results depends on the details you provide.

5.2 Proof of Ownership: we recommend having proof of ownership ready to provide to insurers or the police. Proof-of-ownership documents you upload to Seeker are never shared with partner stores.

6. Service Availability

6.1 Maintenance and Updates: we strive to keep our service available at all times. However, we may need to perform maintenance or updates that may temporarily interrupt the service.

6.2 Service Changes: we reserve the right to modify or discontinue the service at any time without prior notice.

7. Third-Party Websites

7.1 External Links:our service may include links to third-party websites. We do not endorse or assume any responsibility for these websites' content, privacy policies, or practices.

7.2 Data Crawling: Seeker uses data crawlers to scrape websites. The accuracy and legality of the data provided by third-party websites are beyond our control.

8. Prohibited Items

8.1 Prohibited Items: our service does not support searches for banned items, firearms, or any other prohibited goods. You are solely responsible for ensuring that the items you report comply with all applicable laws and regulations.

9. Intellectual Property

9.1 Ownership: all content, trademarks, logos, and data on our website and service are the property of Seeker Technologies Limited or our licensors and are protected by intellectual property laws. You are not permitted to use any of these without our prior written consent.

9.2 User Content: by submitting content to our service (for example details and photos of stolen items), you grant us a non-exclusive, royalty-free licence to use, edit (for example to remove personal details) and share that content, including with partner stores on eligible packages, only to provide our service. This licence ends when your content is deleted in line with our Privacy Policy. You confirm you have the right to upload the photos you submit.

10. Disclaimer of Warranties

10.1 No Warranty:our service is provided on an “as is” and “as available” basis. We do not warrant that the service will be uninterrupted, error-free, or free from viruses or other harmful components.

10.2 Limitation of Liability: to the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Force Majeure

11.1 Force Majeure: we shall not be liable for any failure to perform our obligations under these Terms due to events beyond our reasonable control, including but not limited to acts of God, war, terrorism, strikes, or other industrial action, pandemic, natural disasters, and interruptions to internet services or utilities.

12. Amendments to Terms

12.1 Changes to Terms: we reserve the right to amend these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of the service after such changes constitutes your acceptance of the new Terms.

13. Indemnification

13.1 Indemnity:you agree to indemnify, defend, and hold harmless Seeker Technologies Limited, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the service, your violation of these Terms, or your infringement of any third party's rights.
